Homelink only works when ignition is ON

I have a 2008 335xi (just bought it). My Homelink only works when the ignition is ON, but the owner's manual states that it should work with the ignition OFF.

Please chime in and let me know if...

When I change oil, putting in exactly 6 qts gets me right in the middle of full mark. Usually I have the front higher than the rear, I don't usually measure how much gets drained though.

Turn the key two clicks until all dash lights...

Turn the key two clicks until all dash lights come on (without starting it), and keep it there for 30-45 seconds and the light will go out.
