Air doesn't get in there. Honestly I don't clamp mine but there is potential for it to blow off from the fluid pressure in the reservoir. And it would make a BIG mess. A clamp is cheap insurance.

I doubt a dealer would put the time into doing basically a CPO inspection on a car of this age. But it does look quite nice and if you want a super-low mileage E46 I'm sure there aren't a ton of them...

It depends on the kit. Most of the cooling kits including the one the OP got have a Meyle pump with the metal impeller. We also have a few kits that include the Stewart pump also.
