Does anyone else think this is outrageous? A man is now in jail for two years of his life for exercising his constitutional right to bear arms because the damn government passes bullshit unconstitutional laws...I'm so sick of this crap

Actually, plaxico is an idiot and makes gun owners look bad. I don't believe the man had a permit to carry, and didn't he pull the pistol too?

I'm ok with the ruling. He didn't have a permit to carry in NY (he did have an expired FL permit), was carrying in a nightclub (typically bars are no-no in most states), and obviously was irresponsible if it was falling around in his pants. A guy like that can at least afford a decent holster if he's going to break the other rules, not that I'm condoning that.

a cop killed a kid near by here - dui - he got off in 6 weeks - how is that fair?

Plax does make gun owners look bad. He was an idiot for not having the gun secured properly and even dumber for carrying into a club where they serve alcohol (isn't that a no-no pretty much everywhere???). However, the sentence was BS, just goes to show a flaw in the justice system. Stallworth gets a slap on the wrist for D&D/killing someone, and Plax gets two years for being an idiot and hurting only himself.....

Yea but thats part of my point...he's getting slammed because of this permit bs and the stupid law regulating handguns in NYS and NYC. How did we become so subservient to the government where it tells us whether or not we can carry weapons and makes us pay them for a "permit." This is why its fucked up.

The sentence is such BS...

It's a shame but the way the laws are setup Plax was really just way, waaay, far out of bounds.

CCW permits are virtually non-existant for the average NYC resident. You don't get one unless you can provide documented evidence of repeated threats against your life. Very few are ever issued.

If you do happen to get clearance for a standard permit, you will find they are location specific. You are permitted to carry a handgun only at the locations specifed on the permit. A store owner who wants to keep a gun in his place of business gets granted a different permit than someone who wants to keep a gun in their home.

There is no such thing as open carry in NYC. If you get busted with your gun outside of the permit zone you better say you're on the way to the shooting range at that exact instant otherwise you will face some type of citation.

I'm sure Plax's lawyers did the best they could but, by the book, it is very difficult to justify being out of your permit zone, at night, drinking alcohol, with an unregistered, unlicensed, concealed hand gun in NYC.
