SAN ANTONIO (Reuters) - A public school district in Texas can require students to wear locator chips when they are on school property, a federal judge ruled on Tuesday in a case raising technology-driven privacy concerns among liberal and conservative groups alike.

U.S. District Judge Orlando Garcia said the San Antonio Northside School District had the right to expel sophomore Andrea Hernandez, 15, from a magnet school at Jay High School, because she refused to wear the device, which is required of all students.

The judge refused the student's request to block the district from removing her from the school while the case works its way through the federal courts.

The American Civil Liberties Union is among the rights organizations to oppose the district's use of radio frequency identification, or RFID, technology.

"We don't want to see this kind of intrusive surveillance infrastructure gain inroads into our culture," ACLU senior policy analyst Jay Stanley said. "We should not be teaching our children to accept such an intrusive surveillance technology."

The district's RFID policy has also been criticized by conservatives, who call it an example of "big government" further monitoring individuals and eroding their liberties and privacy rights.

The Rutherford Institute, a conservative Virginia-based policy center that represented Hernandez in her federal court case, said the ruling violated the student's constitutional right to privacy, and vowed to appeal.

The school district - the fourth largest in Texas with about 100,000 students - is not attempting to track or regulate students' activities, or spy on them, district spokesman Pascual Gonzalez said. Northside is using the technology to locate students who are in the school building but not in the classroom when the morning bell rings, he said.

Texas law counts a student present for purposes of distributing state aid to education funds based on the number of pupils in the classroom at the start of the day. Northside said it was losing $1.7 million a year due to students loitering in the stairwells or chatting in the hallways.

The software works only within the walls of the school building, cannot track the movements of students, and does not allow students to be monitored by third parties, Gonzalez said.

The ruling gave Hernandez and her father, an outspoken opponent of the use of RFID technology, until the start of the spring semester later this month to decide whether to accept district policy and remain at the magnet school or return to her home campus, where RFID chips are not required.

The only thing more shocking than the schools tracking their students whereabouts via RFID chips is the fact that it was upheld in court. Fucking disgusting if you ask me.

This is the point where kids need to pool their money, buy an RFID reader/writer, and start swapping their codes around to fvck with the school.

Answer -

They could A have teachers walk around and tell students to go to class, similar to what happens in every other school......OR B install an RFID system.

Some colleges in ny uses RFID, you can't access the dorms without them.

God forbid the kids actually attend class for the little amount of time during the half of the year they have school

Agreed.... What is this going to solve. Either the teacher takes attendance and visually sees students missing or they run a scan and see the students missing... either way... students are not in the room and they don't get their state money.

Have teachers walk the halls 5-10 mins prior to class and ensure kids are moving. If some kids FAIL to report to class, issue them demerits, detentions, parent/teacher conferences and eventually expulsion if they can get to class on time.

You are going to tag and track ALL students cause a couple are not responsible? Hmmmmmmm punishing everyone for the faults of the few.

I would remove my kids from any school which approved a program like this. I wouldn't even wait for the RFIDs to be issued. Passing something like this shows that the school isn't focused on educating my child along with a myriad of other problems, so clearly that wouldn't be the best education they could receive.

I'm honestly amazed at how little importance our education administrators give to actually teaching the kids the best way possible.

Test scores to secure funding and mindless / redundant administrative overhead literally chokes a teacher's ability to teach kids.

My wife is a speech language pathologist at one of the best districts in our area (same as where I live) and they have an unbelievably tough time focusing on teaching kids due to the reasons I mentioned. Finally one teacher had the courage to bring up the topic to the superintendent and school board, so I'll be curious to know if anything is done about it. My wife forwarded me the letter that was sent by the teacher to the administration and it really changed my whole perception of what goes on in schools these days....even in "great" school districts.

We had already been considering private schools for other reasons, but now I'm even more convinced. Even if I have to eat Ramen noodles my kids will not likely go to a school where they are second priority to a bunch of administrative BS.
