Getted screwed over by a fanatic!

I got in touch with a fanatic who was looking to trade his resonated super sprint xpipe for a non-resonated version. Everything was going well, we were going to cross ship parts with no cash exchanged (I paid shipping both ways).

Fast forward, my car has been in the shop for two weeks because he has not sent his part back. He told me several times that it should have shipped. Sure enough, he was waiting until my part arrived to ship his to me. He got the part and claimed it was fake. I told him to contact super sprint and verify the serial number. Knowing the part is genuine, I was a little upset that he was being a jerk about the process, but not all too worried. He told me he should be getting conformation back from supersprint on the serial number on wednesday, but I haven't heard from him since (I sent him two texts yesterday and two today with no response).

I have his address, email address, cell phone number and e46fanatics screenname (which I'm not going to release just in case he follows through. If he doesn't, you can be damn sure his sn will be posted). I was able to lookup the address and get a name as well, but I believe the address is his parents as the name I found was the name of a doctor and the person in question clearly stated he worked as a mechanic. I'm guessing he lives at home (maybe Dr. Dad bought him is M ).

My question is: what options do I have. The person in question is from a different state. Can I take him to small claims court? Can criminal charges be filed? At this point I either want the part I was promised, or my old part + the cost of the shipping labels and labor to get the part removed and put back on.

OP - yes you can file in small claims court and request to cover the total cost of what you have put out. You would have to file in his state as that is where the "incident" occurred. As far as criminal charges, that would be harder. You would have to be able to prove that he "intentionally" intended to fraud you to profit personal gain. If you could prove that then it could fall under Internet Fraud, but that might be very hard to prove. I would contact the courts in the city where he resides and question what the cost is for filing a small claims suit. Maybe armed with that information you could contact him and tell him that you are prepared to proceed with the suit and he will complete is part of the deal. Good Luck.

Thanks for the info, I've never had to do anything like this before. Guess I'm a little naive and prefer to see people as good, well meaning people. Typically, would one need to be present at court if a suit was filed?

Yes you would need to be at court unless you were planning to pay for representation, an attorney, to be there on your behalf. That would cost quite a bit and the cost might not be recoverable in the suit. Depends on what the courts/judge allows as recoverable expenses.

Man that blows, sorry to hear that happened to you. It's sad when you do what you did and the guy is obviously a jerk. If you have all the info that you appear to have, he wouldn't be hard to find. I do it all the time, if you would like you may PM me any details and I will tell you if it's bogas or if any portion is accurate I can tell you we're he went to elementary school. Also I believe if you have an a agreement, like emails, PM', etc that still makes it a legal binding contract in which you would not necessarily take him to small claims court but even better file a lien on his car. I will do a little more research on the matter but I'm pretty sure you can.

As an update:
I was able to get in contact with his wife. Turns out the father is actually the guy I'm talking to. Either there is another "Frank A Busse" in ATL that works as a doctor, or this guy lied. I'm guessing the latter. Anyways, the wife told me that he wasn't happy with my pipe and he was "in the process of getting it shipped out". I'm not sure if this guy is the laziest guy in the world...but he got the part on tuesday and claimed to have the pipe I was supposed to get shipped wednesday the 2nd (2nd day air shipping by the way). At this point, I'm likely out 400-450 at the shop for putting the part on, taking it off and what will be 2 weeks worth of storage (if I can even get the pipe back). So I'm going to press for that money as well (after I get the pipe).

The long and short of this is I've learned a lesson that some guys are just bad guys. I'd like to think that everyone is a fair, level headed person, but that's obviously not case.

Unfortunately some people (A LOT ACTUALLY) just don't have any INTEGRITY or HONOR within them.

Sadly, this is the case...

UPS is now showing the package it's in transit! Should be here Monday or Tuesday. Phew. While I wish this has gone better, I'm just glad to be made whole and not out the additional cost to replace parts.
