This is not a SCOTUS issue. This is a state's rights issue. The Constitution is a limitation of the powers of the federal government. The Constitution only begins to dictate that of state's rights with specific language starting at the 14th amendment.

Well, the OP was correct with his facts. The looting in NY/NJ was done mostly by minorities. The fake con-ed (power company) worker scams were all black. The Jersey Shore was looted heavily by hispanics.

I don't see truth as racism. If you laugh when Chris Rock says the word crackers, then you have no business telling someone that they are wrong when they use a derogatory word for a minority.

Fair point, and to be clear, I wasnt really saying OP is a racist. Rather, whatever arguments you make about gun ownership tends to get disregarded when you add some racial slurs in there as people would tend to lump you in with the crazy, racist gun-nut demographic...

I said the same thing earlier. Even if what you are saying is true, it detracts from the point and just gives people something to argue instead of your point.

Unfortunately, I think you might be mistaken. Look what happened in illinois recently when the SCOTUS ruled on concealed carry. If you give them the authority to rule on that state decision, expect them to rule on this one too. The door has been opened for federal meddling in things that are reserved to the states. New York can make whatever gun laws it wants as long as it adheres to the state constitution. Feds have absolutely no authority on this whatsoever.

Interesting cases to look at will be NRA vs Chicago and McDonald vs Chicago. It will interesting to see how NY argues their actions. However, Il has an interesting read on the subject of guns.

SECTION 22. RIGHT TO ARMS: Subject only to the police power, the right of the individual citizen to keep and bear arms shall not be infringed.

If the cases above could provide any insight the state of NY could get away with limitations as long as they don't prevent individuals from legally owning weapons (as was the case of McDonald vs. Chicago).

I do find the wording of Il Constitution be unique. What does that mean, "Subject only to the police power"?
