so they repaired it for free even though the class action deadline was in 2010?

It took them 2 months to figure out why my vin didn't show up in their computers untill they tracked down it was registered in bmw of Canada, then another 2 weeks of peperwork to reregister it in the bmwus, and 2 weeks to find a shop that had the "equipment" to cut the floor out and reattach the new one so by the time it was said and done I was a little irritated with the time that it all took so they covered the repair but I had to cover the driveshaft, and a few other things the the subframe issue caused damage to

Call BMWNA in NJ. It is easier to get the repair done at BMW owned dealerships as opposed to Franchised or Invidually owned dealers.

BMW of Manhattan for instance is a BMWNA official dealer. Hassel BMW in Freeport, NY is an independant dealer.
I spoke to BMWNA and they said to bring it to one of their dealers to avoid 'the-run-around. Guy was very honest to me. He said they "might" cover the repair but the only way to know for sure is to book the car in for an appt. which is at your own expense (but could be covered if the repair is necc.) Alot of technicalities I know.

This is after the service bulletin has ended btw. I called him on Monday.

So made a complaint with BMW, talked to a supervisor Betsy Hohmann. She was helpful but she wanted me to take my car to the local BMW dealerships sister shop which was a Ford dealership. This was because my local BMW had no idea what a torn subframe was or how to fix it. She told me she would only be able to help me out if I went to the Ford dealership. I just assumed Ford would charge me 3-4 grand and only fix the one side that was torn. So I went a different route and brought it to a reputable shop where they are going to fix the crack and install the TMS kit for right around $1,000. Just wanted to give an update to everyone as far a BMWs flexiblity to compensate us on the Goodwill Warranty.

What happens if BMW performed the recall and it cracks again?

My guess is nothing. You will probably be out of luck. Pretty sure there was no warranty made.

And it wasn't a recall so they aren't under any nhtsa pressure to do anything. People always make that mistake, it wasn't a recall it was a voluntary program and the difference is huge.

2000 BMW 323Ci

I bought a 2000 323Ci in july 2011. 3 weeks ago, i learnt that i have subframe problem. I made some research and i found your web site. I am mad that the dealer never inform me of this problem even though i visited it several times since i bought this car.

Moreover, i live in Canada.... But, even so, i will fill a complaint to BMW Canada and i will let you know. I will have my car repaired anyhow.
