With this court nothing is a slam dunk. As I said, don't take my word for it. Look at the ruling of the 9th. The ruling of the 9th uses both Loving and Romer in fairly specific terms.
The 9th Circuit is the most overturned Federal appeals court in the judiciary except for the 6th. Citing their reasoning generally doesn't bode well when it goes up for review at the Supreme Court.

We shall see. The USSC wants to punt on this whole issue. In the short-term they are gonna get crucified either way. The long-term, well that remains to be seen. If they strike down DOMA (including prop 8) those will be two landmark decisions. I hope they do.
