Contesting VA Traffic Tickets

Awright, I know some of you gentle drivers gotsta know this...

My wife just got a 20mph ticket this morning (6 points) and I was thinking of having her "contest" it:
  1. Hope the cop doesn't show up and ticket is dropped altogether, or
  2. If he does, bargain down the ticket a bit (first ticket wife ever has gotten).
Are these both viable options for VA (Arlington Cnty to be specific)? I've done both in MD in days past to some success, just want to make sure things workd the same way here in VA too.

idk I got a ticket in that area and tried to talk my way out even by saying I worked for the same govt. lol You can say that this is her first offense and they might lower it. But since this is the beginning of a new fiscal year I doubt it. You can try. Be honest and it might work.

Naw, just a speeding ticket, not a manslaughter rap. I'd end up dishing out more for the lawyer than the ticket.

20mph over what speeding limit? Did the officer write the word reckless anywhere?

Get a lawyer.

20 over is Reckless which is a felony/misdemeanor, depending on severity/circumstances, and it will stay on her record for 5+ years. Even if its a first offense, a reckless on insurance is a black mark and your premium, even for a female driver, will still be noticeably higher.

Even if you can get the ticket reduced to 19, its categorized as just a speeding ticket which is the same as 3mph ticket. Insurance companies don't look at the speed of which the ticket was written, just the category of the offense committed. Yes, your insurance will still go up, but not nearly as high. A normal speeding ticket is only worth 3 points and only stays on your record for 3 years before dropping off. So your insurance will only be up for 3 instead of 5 years.

20 over becomes a misdemeanor III over 80mph. This is the jail time zone, 70 in a 50 should not be considered a misdemeanor but va dmw will probably suspend driving priviledges in va until a defensive driver class is done. Lawyer would be nice because it could prevent such suspension and drastic point reductions in her md drivers lic. Lawyer should convice the judge the she is not reckless driver, blah, blah. Otherwise you will pay the fine, then do whatever md requires you to do to gain those points back.

The cop WILL show up. They arrange the court dates around cops schedule.

Re: Contesting VA Traffic Tickets

i live in MD. Have gotten 2 tix in VA rural counties (rappahanock and some other bumpkin area years ago). The schedule is for all tix in a given period for a given trooper to happen on the same day. Essentially, that day the trooper goes to court instead of patrolling so no i one can get away by saying he wasn't present
