Key won't work, car thinks tops open

So... My top stopped working a while back and well I've been opening and closing it manually. But since then I haven't been able to use the remote (slightly annoying if you're still the type to open doors for the ladies) Is there any way of tricking the computer into thinking the top is closed and deactivating the fob? I might add the keys I have are newClick image for larger version

I don't think the top position effects key fob function (at least mine work with top up, or top down.)

When you got the new key, did you program it for the car? If not, google e46 program key - and follow the steps.
If you did, you might try doing it again (but this should not be necesary).

I think it has to be programmed when the top is closed though

I programmed my spare key with the top down. Just for fun today I tried the buttons when the roof was half open - they unlocked and locked doors just fine. It did confuse my top, being stopped part way open, but with a little help it remembered what to do. I don't think the lock and unlock function care about the top. They do care if the door is open or closed.
I did not try to reprogram my key with the top stuck part way open. I'll bet it would work fine.

Let us know what you find so the next person who comes along can gain from your experience.

Yeah I'm going to do a bit of research and see what I can do I feel like it can't be programmed until it's completely locked :/
