BMW/Nissan Going To War Over The Letter "M"

So you think BMW has a case or what??

Quote:
"How much is a letter worth? When it comes to branding hot cars, BMW says it has invested at least $260.7 million internationally over nearly 30 years promoting its M series.

So it took offense when a Nissan Canada ad campaign used "the M is coming" - with a capital M and a Nissan logo - to advertise the Infiniti M35 and M45.

BMW sued Nissan in Canada's federal court, alleging trademark infringement. It says it fears even aficionados could confuse Nissan and BMW cars.

But BMW has not produced any evidence of harm, the judge noted in denying BMW's request for an injunction to stop the ads.

No proof, no injunction.

The judge, acknowledging the importance of the M cachet to BMW, told the companies the case would be heard as soon as possible, perhaps late this year."

yeah I also heard that Nissan sued BMW and made it to where BMW could not import "Z" keychains to the US, since Nissan has the Z line. BMW of course using it for the Z3/4/8.

that's not true because BMW had Z concepts long before Nizzan/Datsun had a Z.

I think they going at Infiniti because:

1. They are rivals
2. They are both in the car business
3.

haha i always wondered about that Gillette M3 thing.

I never really thought the Infiniti M would bother BMW, especially since Mercedes has been calling their ML cars the "M"-Class for such a long time.

I don't think it matters legally about the Gillette thing anyway. I read somewhere that you can have some overlap as long as the industries are separate enough. For example Kellogs has Tony the Tiger and Exxon has their tiger. They are almost the same but they are far enough apart that they can use a tiger for their logo. Now if you have an M in the same business that gets dicey. I know you guys were just kidding about the Gillette but I thought I would chime in with some useless unfounded trivia.

Infiniti M ... Nissan Z ...

I am not surprised at the case though... makes sense. If someone told me "M", i'd think bmw, but if there's a nissan/infiniti logo it soudn't be confusing at all.

I imagine bmw didn't push this before with Nissan as they weren't promoting their M as a sporty car but now that it is a performance car, they want to distinguish the two better (not to mention the fact that the bmws are starting to resember infinitis )

I remember when the commercial came on, my first impression was like "Isnt the M associated with BMW more than Infiniti?"
