If you drive drunk with a child in the car, you should be beaten for 30 days (I would say killed, but then they lose a parent).

Smoking with a child in the car should be the felony

so wait, im having a hard time understanding this story...someone (maybe a friends parent or something) was driving this guy's daughter around while they were drunk, got in an accident, and she was killed?

Also, the majority of DUI's are given between the hours of 6 and 10am. Not a lot of people realize that even after 8 or even 10 hours of sleep you can blow a .08 or higher. I'm for making this a felony, but it would have to be in certain circumstances.

I'm under the assumption it was his wife driving? He mentions how he has no one left, so that's the only conclusion I can come to. But I do not know.

too bad even if that law passes, it's only in NY (I know driving is state-regulated). I have no sympathy for drunk drivers, there's never a good reason to do so.

agreed. think how many lives would be saved...its sad its only a felony after somebody gets hurt, seems kind of backwards to me.

to me driving drunk is no different then shooting bullets down the street, you are creating great opportunity to injure/kill somebody
