The whole family was killed... I don't see how anyone could get money out of this. Who would pursue the lawsuit anyway?

i probably would have tried to spin the car out, which may have resulted in the car flipping.

When your gas pedal is depress (no telling what position it was stuck in) it doesn't take long o get from 60-90 in that car. He probably wasn't even aware of it being stuck until 70mph. And who's to say applying the e-brake wouldn't have caused a loss in traction followed by a fatal crash?

yeah thats gotta be scary as hell but why wouldnt you just pop it into neutral. thats the easiest way to cut power to the wheels. then try the e-brake or normal break.

why werent their normal brakes working again?

RIP. To the defense of the deceased, most people who drive doesnt know shit about cars. All they know how to do is get in, turn it on, gas brake, turn on the radio and a/c. In an emergency situation, most will panic and freeze up. Since it was a loaner, multiply that ignorance by two.

Sad story for sure. I'm sure it's completely different when it's happening, but My first try would be nuetral and braking, if that wouldnt be possible I'd try to put the car into a lower gear and contiue braking while shutting the car off. Last resort try to keep sideswipping a guard rail to slow down.

This makes you think though, what do you do if the car is the type that doesnt have a physical gear lever but instead the buttons you push to change gears. You're royally screwed then if the electronics arent working properly.

And start/stop buttons DO allow you to shut the car off while moving, I know I'm able to do it in my car.

This is another reason why our driving exams should be more demanding and require more knowledge of cars and how they work such as in Europe.

similar thing happened to me and my friends in his VW 5 years ago. he panicked and started screaming. i was asleep in the front passenger seat. i woke up and pulled the e brake, even then we skid for a good amount and went through a house......
