When you press the open top botton, nothing at all happens but flashing light? So top doesn't even move a tiny bit up?

Definitely take a look at this thread http://forum.e46fanatics.com/showthread.php?t=854059

Hopefully it's as simple as the broken wire harness. I was going to wonder if it was the latch, but you aren't hearing anything. Sounds like nothing moves at all, which makes me think of the wire harness. Taylor will have better info.

Thanks. Would you take this to the dealer?

Only if you're not capable of fixing a broken wire. If no broken wires have a shop (any BMW shop, not just the dealer) read the CVM codes. The flashing light indicates a stored code, and that code will help a ton to figure out what's wrong. Shop should charge 1/2hr labour to read the codes, well worth the expense.

My guess would be the car does not think the storage area is properly open, or the car thinks the trunk is open.

Good catch! yet...
1. The light is typically yellow, not flashing red, if the the storage area is not fully down.
2. The dash usually displays the trunk is open if the trunk wiring is the issue.

Both are definitely worth checking though just to be sure.

This may be too stupid simple, but mine experienced this and I thought I checked all the fuses. Took it to the dealer and it ended up being a fuse somewhere in the middle of the fuse box.

Yellow light means the storage compartment is not fully down. If it is then the sensor might be sticking. Try opening and closing the storage compartment to get the sensor to work. If that doesn't work then the sensor might need cleaning, might be bad, or I've read people having found broken wires in the trunk.

Don't want to sound dumb but do I need to lower the top manually and then unlock the storage compartment?

Just fiddle with the storage compartment. Open close it a few times and hope the sensor resets, otherwise you'll have to investigate why the sensor failed.

I have did this also in the past and it worked for me, also told a fellow vert owner about this and worked for him, so as above open and close the storage compartment and hopefully it will work again

Looking for mechanic

I am in Concord CA. And I am looking for a mechanic in the east bay. I have taken my 2001 330ci to the dealership up to now 103k. Just can't see the value anymore.

Needs tune up and the top issue on original thread dealt with. Any suggestions please let me know.
