In any event: it's a really unfortunate situation. But the article gives so little information that it's impossible to say anything more than that.
walmart or bass pro. any place like that. i've seen them all over. they look straight legit. only way to tell is to look close or hold it. if you painted the orange tip it'd be very hard to tell. and i would absolutely take someone out pointing it at me (not saying the kid did). i'm not gonna take the time to analyze every gun i see to tell if it's fake. that second i take could be the death of me.

It's really a shame that kid didn't choose to be bulletproof.

I hadn't realized that. I thought they did away with toy guns like that years ago. I remember having some (awesome) toy guns back when I was a kid, but the last time I looked everything was either entirely orange or otherwise designed to make it obviously fake.

Anyway: it's a sad situation. I can't imagine losing my son this way.

But that's an actual rifle, not just a toy. Don't you have to be 18 to buy one?

I agree that it looks much more lethal than it actually is.

EDIT: yep, your next post seals it. If someone pointed one of those at me, I think I'd be justified in fearing for my life, at least for a few seconds.

Trayvon Martin was 17.

We are all Trayvon Martin.
He attacked someone.

This kid by all accounts was walking around with an airsoft gun(granted one he modified to look real) and didn't point it at anyone. Probably froze when real guns were pointed at him.

Carrying a gun is illegal in cali..? yes but should the penalty for this be a firing squad?

The article doesn't state whether the kid pointed it or not. In fact there's very little released information.

And now 13 year-old and 17 year-old unarmed children who didn't attack anybody are dead.

they fired on the assumption that the gun was real and on the protection of the officers. if the kid had dropped the gun it would have went ok. it's just an unfortunate situation. no one is really to blame :/

They told him to put it down and he didn't from a couple yards away, I'd think it was a real gun.

This is the key issue here. The article is silent about whether he pointed it or not, but the language suggests that maybe he didn't. You would expect that if he had pointed it at the police, they would have said that right away.

I will.

If I see a kid walking in my neighborhood with real looking AR15, you bet I'm calling the cops. IDGAF if they're playing cops and robbers. Do you really play cops and robbers with real looking weapons in public at the age of 13? He should have known better at that age.

At least you're consistent with your view. I can respect that.

But to congratulate someone for killing a child... eh.

True story: when I was about 16 a bunch of people I knew on an online BBS got together and had a "war" out in the open space in Shell Ridge in Walnut Creek, which was right behind my house. Everyone had replica guns that shot plastic pellets at a relatively high rate of speed. Every one of these guns looked totally real--no orange barrels, etc. The guns were even weighted to feel real.

Halfway through this exercise, several deputies from the sheriff's department showed up, shotguns drawn. They directed several of the kids, in no uncertain terms, to drop the guns and get on the ground. The kids complied immediately.

Apparently someone had been jogging in the area and saw a bunch of kids dressed like paramilitary folks and called the cops.

In this case, though, once the cops examined the guns and determined they were fake, they essentially patted everyone on the head and told us to have a good time.

The End.
