Just approach him in a respectful manner and let him know what's going on. If he's a d!ck about, then you can be more aggressive in your next move. The fact he's just letting his dog out to roam like that is not a good sign, though.

The dog does not roam. It comes to my yard, does its business and then goes back inside. I'm going to talk to him tommorow.

That's my point. Based on your description, he's not there WITH the dog, so it is "roaming" alone. Responsible dog owners wouldn't do that; hence my comment about it not being a good sign.

If you haven't met the guy, ask some other neighbors about him ahead of time and find out if hes a problem. I ran into a situation where I had a totally reasonable request but the neighbor turned out to be batshit crazy. By the time it was all over I'd called the police a dozen times and never left the house- even to go in the front yard- without a can of mace or a baseball bat by my side. You never know who you're dealing with.
