Resigned from my job and being "forced" into a 30 day garden leave...

So attorney's of OT, I need some advice. I'm a VP in Private Banking. I recently resigned and the manager is being a d-bag and enforcing a 30 day garden leave. I gave 2 weeks. I'm not in a sales capacity, so there is no risk of me taking clients with.

The manager said if I don't want to work the garden leave, I can use vacation days. There is obviously not a business need and therefore I don't feel like the garden leave is warranted.

Thoughts?

I live in California BTW.

There is an issue with getting paid for 30 days without actually showing up to work?

I am assuming you are upset because you have a new position with a new company?

Not sure what the problem is.

Not trying to burn bridges, but you typically don't work while on garden leave. I'm an employee at will and the fact that I HAVE to work a 30 day garden leave, goes against said at will policy.

Not a lawyer, but...
  1. You're supposed to be on the payroll during said leave.
  2. These things (non-competes) are practically unenforceable in CA, regardless of how scary the wording sounds.
Given your boss is only asking for an extra two paid weeks, though, it may not be a bad thing to just go for it... you should bring it up with your new company and see what they want to do.

I work in PB and we just got a 90 day notice before christmas. My whole staff is on call sitting at home collecting a paycheck. While management still has to go into the office.... I pretty much sit there doing nothing all day in the office while my staff is at home.
