Called and made an appointment with one of the local dealerships so they can look at my car tomorrow. I told them i already know what's wrong with it and gave them the background. They said they would charge me 1 hour worth of labour ($109) to do the inspection so I can formally complain to BMWNA with proof that the problem exists. They also told me a BMW rep. was coming out there on the 28th so if everything goes well i'll be taking my car back there to have a little meeting with him (or her).

I recommend that everyone try this route, along with making complaints at every possible level, to help get some possible action. I'm also taking a printout of the names listed and the german article about BMW AG addressing the issue as proof that it is not as isolated as they claim. Hopefully, they realize i'm not about to roll over and just let my insurance deal with it, even though that is the probable outcome.

For everyone out there that have made comments about how we are taking this to far, i beg to differ. I think it has not been taken far enough. Right now a lot of people have the better them than me attitude, but i assure you that the subframe and diff. mount issuse are only going to get worse. I'm positive there many, many more cars affected that have not even been diagnosed yet. I'm not running around saying BMW's are **** or trying to scare anyone but this is a real issue and until you experience the frustrations of the specific situation, your comments hold no weight.

Thanks for the info. By the way and you steer me to this article so i can take it with me to BMW. I also was on BMWUSA.com and checked warranty under the 3 Series, and it says this.

"BMW NA provides limited warranties for any new U.S.-specification vehicles distributed by BMW NA or sold through the BMW NA European Delivery program against defects in materials or workmanship to the first retail purchaser and each subsequent purchaser.

The warranty period is for 4 years or 50,000 miles, whichever occurs first, and begins on the date of first retail sale, or the date the vehicle is placed in service as a demonstrator or company vehicle, whichever is earlier.

Please see your authorized BMW center for additional information on coverage and limitations.

BMW provides a limited warranty for itís 2004 and newer vehicles against defects in materials or workmanship which will result in rust perforation of the vehicle body for a period of 12 years, without mileage limitation, commencing on the date of first retail sale, or the date the vehicle is first placed in service as a demonstrator or company vehicle, whichever is earlier.

this sounds like it's for body panels, vs. a chassis issue like the sub-frame...also, the subframe damage is not a result of rust, it's the metal fatiguing under stress and tearing apart...not trying to bust your balls Art, because i think a lot of us are going to experience this sooner or later, just giving you the probable interpretation that BMW will give you of that sentence....

i also posted the link to the German article in your other thread for you guys a few hours ago...

again, Good Luck w/this...i hope you get it sorted quickly and favorabley...

1999 328i with 50K Subframe tear on driver's side.
Fixed under CPO. no longer own the car (if this mattters)
