Well I just got a call again from BMW (a couple days ago they said they would only cover 50% of the repair). Anyways they said they 'reconsidered' and are now going to cover 100% of the repair.

i spoke to a peson at tuner motorsports the other day and he told me bmw doesnt "fix" the problem , but cuts the entire cars under belly out. he told me if they do this your car will never be the same. the only way to fix it properly is to reinforce the mounts with thicker steel.

let me know how they fix yours?
if you opted too go to tuner it would be cheaper and done right . will they cover that?

To be clear, the Turner kit can only be applied AFTER a failed mount is repaired. If the mount has torn through, the turner kit will not fix it. They have to repair, ie replace, the torn metal and then apply the turner kit to all four rear mounting points. Turner may be able to do a repair of the torn metal that is less invasive than the full replacement of the rear axle carrier (see the photos of that, and yes they literally cut a huge piece of sheet metal out). I would also trust that Turner could do this as they are particular in their work with allignment. Realize though that there are two things that need to be done, and this will be more than the $1200 cost to install the kit, as they need to fabricate a new mount.

I setup an online appointment with my local dealership for Dec 15, but I wasn't comfortable waiting that long. I dropped the car off at the service dept on Tuesday around noon. Wednesday they called me back and offered me a "loaner." I received another call today suggesting that they will not be able to look at the car until early next week. Hopefully all goes well, because the "loaner" is on their dime and I am hoping to have it until my car is repaired.

Exclamation add me to the list 328ci subframe damage 51,800 mi.

Add me to the list. jhuff328ci. The entire rear end ripped away from my subframe. My car has been lowered and has different rims/tires and a lot of other upgrades throughout. It only has 51,800 miles on it. I was concerened about BMW denying my claim. I spoke to the shop foreman at a dealership nearby. They were very familiar with the problem. He asked me to bring the car in the next day. I brought it in and received a call the very next day saying they would cover the entire repair cost AND they gave me a loaner. THANK YOU BMW. If this has happened to your car BMW DEFINETELY owns this. Be nice, but be firm. there is a class action lawsuit in the works for this. It is covering ALL 3 series cars from 1999-2005. The URL is on one of the previous pages. If you cant find it, let me know I will give it to you. I called them just in case and they are really eager to get as much response as possible. I received a call back from them in less than 8 hours on a Sunday. Bottom line: DON'T TAKE NO FOR AN ANSWER. This was none of our faults and BMW needs to correct this for all of us. I intend to have them install the TMS subframe kit as a precautionary measure also. I will be paying extra to have the TMS kit installed. I will be documenting my entire process to hopefully help out any others that are having this same problem. The dealership said it might take up to 1 month to fix.

Anyone deal with Niello?

My subframe is completely pulled out from the trunk, looks worse than anything I see posted before on this thread. My car is completely stock (sport package specs) with wheels and tires off of a 330, which is within the stock tire and wheel sizes listed on the door. No suspension mods or anything to negate a manufacturers warranty. Just a crap load of miles... But, that isn't anything new in my book, this is my third BMW (e30 286k, e36 191k, e46) and they all had WAYYYY more miles than this one.

Has anyone dealt with the Niello dealerships or anyone else in NorCal? Any feedback, suggestions? Thanks guys.

330i sports pkg 2001 4door ** no damage **

I inspected my car a little while ago. Jacked up the back and lit up the bottom with a high powered light. Looks fine. No cracks or even cracks starting. I have a sports pkg and its a 2001 so maybe got lucky (??)
Good luck to everyone out there if you have any issues; let me know if I can help (I can check my car every so often and report back or I have some mechanics contacts in Dallas if anyone needs one).
after reading all this, Im thinking of getting an after market warranty (98000 miles for 3K $ - currently have 55K miles on it).

Listen here people, As one of the first ones to get BMW to pay for this problem and get it fixed, BMWNA will pay for it not the dealership. I wrote letters to BMW NA and to the CEO himself throught certified mail in which I received a much faster response from. Be a little patient when going to these dealerships and there is evidence of BMW actually paying for this as there should be a picture of my invoice I posted showing they payed for it.

Depending on the severity if damage your car has, I STRONGLY suggest that you have them cut out the rear crossmember axle sheet metal and get them to replace it with that of one from an //M3 since this is how they replaced mine.

Sounds great. I called corporate last week and they acted like they have no idea what I was talking about. In the mean time, I have been able to adjust to the movement in the back end... It's like having a folding 70 series sidewall on my driver's side. Later.
