Law fanatics. What is the penalty for running from the police?

Preferable in California but anywhere will do. Let's say cop radars me in my M3 going 60 in a 45 on a COUNTRY ROAD. Puts on his flashers, but I take off doin anywhere from 80 in the twisties to 150 in the straights. But I never cross the center yellow line and there was never any other cars cuz of the country road. Technically my only traffic violation would be speeding, correct? There was no alcohol or drugs involved in any way and I had a clean record.

What would the penalty be for running from police? (assuming I get caught)

Jail? Probation? Suspended license? Is it a felony? How come you hear about celebrities who are drunk and sometimes with drugs run from police and they get house arrest for a week with 6 hours community service and post bail. Can that happen to a normal citizen?

The speeding will get you a reckless driving charge, and fleeing arrest is also a crime. I wouldn't consider it for a moment.

No, because contrary to popular belief, we are not all equal.

Celebrities get away with all kinds of stuff, and get nothing but a slap on the wrist.

are you serious? do you even need to ask? its a felony. in most jurisdictions, i think. high degree misdemeanor at the very least. and of course its punishable up to jail time. if that cop has a dash mounted cam or took down your LP, you are f*cked

very commonplace around here, i know a solo pract. atty whose sole business comes from scenarios like this.

why did you run? just bite the bullet and pull over. can always fight a speeding ticket.

EDIT - considering you got away and a chase didn't ensue, if they do put out a warrant for you, itd be considered "low priority." meaning they'll arrest you when they get around to it. could be a couple of weeks, could be a couple of months, could be over a year. i'm not trying to scare you, just saying that's how it works. around here at least. every couple of months, they do a saturday morning warrant sweep in dallas and tarrant counties. go after child support deadbeats, traffic warrants, etc. looks good for the evening news, i guess.

Set the 150mph in a 45 mph zone aside; Evading a peace officer is a misdemeanor -violation of VC section 2800.2(a) of the California Vehicle Code.

The Bail amount for that violation is $35,000 (in Los Angeles County) see page 26 of the Misdemeanor/Infraction Bail Schedule for L A County which means you will be taken in. If you post bail --> you go home. If you don't --> you'll stay in jail until you see the judge.

As for the actual punishment (fine/jail time) it depends on how good of a lawyer you have.

So actually that is not all that bad.

Evading police officer: $35.000

running from the cops is a felony and unless you can prove that you weren't aware that you were running from the cops, then yeah, say hello to some jail time

Here's the actual Vehicle Code Section:

http://www.leginfo.ca.gov/cgi-bin/wa...ction=retrieve

Quote:
2800.2. (a) If a person flees or attempts to elude a pursuing peace officer in violation of Section 2800.1 and the pursued vehicle is driven in a willful or wanton disregard for the safety of persons or property, the person driving the vehicle, upon conviction, shall be punished by imprisonment in the state prison, or by confinement in the county jail for not less than six months nor more than one year.
The court may also impose a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or may impose both that imprisonment or confinement and fine.
(b) For purposes of this section, a willful or wanton disregard for the safety of persons or property includes, but is not limited to, driving while fleeing or attempting to elude a pursuing peace officer during which time either three or more violations that are assigned a traffic violation point count under Section 12810 occur, or damage to property occurs.

It is pretty hard to out run a radio if there are other cops in the area. But I do know a person who out ran the cops twice in his 330 over the past three years but for justifiable reasons not speeding.

It is also listed under the Felony Bail Schedule w/$75,000 bail if combined with reckless driving (which could be the case for this thread -150mph in a 45mph zone-).

See page 11 of http://www.lasuperiorcourt.org/bail/pdf/felony.pdf

I guess it would depend on the officer's statement and how the DA wants to prosecute.

I've only ran once when I was on the West side of St. Louis on I70 (Going East) doing 125MPH with a GT Mustang (fun highway racing). We were hitting close to the 130MPH mark when we went through a highway underpass; I looked to my right (was in the righthand lane) and yup, state trooper sitting there with a laser gun. We both downed to a lower gear and gunned it and took off. I took an offramp at about 90MPH and tucked into a residential neighboorhood coldesac. After shaking for about 30 minutes I got back on the interstate.

I considered the options for about 10 seconds:

1. 130MPH ticket in a 70MPH zone, lose my license, go to jail, get screwed hardcore for having SAFE fun with no one else on the road except myself and another guy.

2. Run and risk arrest (would have been arrested anyways) and get my license taken away, etc.

The choice was simple for me.

In most cases, the individual who attempted to evade an officer is charged with a felony.
