I'm pretty sure the waiver i signed released him from being responsible for such a mistake in any way. He's an honest, good guy though. If I'm in that area I'll stop and talk to him today or next weekend and let you guys know what we decide.

This quite honestly could be the funniest/saddest things I have seen in awhile.

Generally a tattoo artist will disclaim all damages and limit their liability to fees paid. Perhaps a court would throw out the contract if the client asked for a Greek phrase and was given a tattoo of a giant d!ck, for example.

But, given that the client most likely signed a contract with the above terms and also signed off on the design, he's most likely S.O.L. No court is going to say the tattoo artist has an inherent obligation to make sure the client's Greek spelling is accurate.
I disagree. I don't have tattoos and never even been in a tattoo parlor, so no experience. Just speaking from a common sense perspective.
If you went to a shop that make signs and gave them in writing what you want, and they fabricate a sign for you misspelled, are they liable?
Why would tattoo guys be above that expectation?
The problem is... the sign guy would just make you another one.
Even if the tattoo guy agrees to a re-do, would he also be liable for an erase, if that is even possible?

The client signed off on the design and signed a contract where the tattoo artist disclaimed all damages and limited his liability.

This trumps tort (negligence) claims for malpractice/professional liability. The client's only recourse would be through the contract, which says he has basically no recourse.

And it's fine if you disagree. I have numerous court decisions backing my opinion, so I'm going to stick with court decisions over Master Po's common sense.

Definitely correct.

Master Po's example of the sign reprint is more of a customer service thing (ie: keeping the customer happy) versus bearing any legal obligation in having to reprint a sign. It just costs less to reprint the sign and keep the customer happy vs. fighting it and risk your business reputation.

Much better than the standard hideous ripstop gear for fat dudes to pretend they're athletic. Nothing like seeing a 400lb dude who can't touch his toes get garbed up in tactical gear to play army
