At least that's a reasonable starting point.

Next question: 5 speed or auto ???

You of course could be a bit more helpful by listing all of these simple variables.

Also if your a DIY guy 330 intake manifold swap. All 3 of these can be done for your budget.

That's to bad it's an Automatic trans & not a Manual, one mod I was going to suggest was a Diff swap to a 3.46 Ratio. But your automatic already has a 3.46 diff.

The easiest & most cost effective mods for you would be:

1) Shark Injector (software) $350
2) Cosmo Racing Long Tube CAI $150
3) A new set of NGK BKR6EIX Spark Plugs $45
4) BG 44K Fuel Injector Cleaner (2) cans $40

A Header would be a great mod, but they are a PITA to install. Also if you live in a state that is big on Emission Testing, headers (no Cats) won't pass a test, but they do make good HP.

You could try to locate a 3.64, 3.73, or 3.91 diff because that would be a very noticeable improvement in acceleration, but they're not that easy to find. Install on a diff is relatively easy though.

not to hijack but seeing as how someone knows a little about the diffs here, I have an auto 323i my00 can I swap to the manual diff? I want to lower my cruising rpm (I only d highway driving)

for the OP, these cars are never going to be fast, you'll get better kick out of weight saving then adding bhp for a budget. Im looking to go to a m54b30 sometime this year and in Australia without any modified parts to fit that will run me about 2500$AUD for about 40hp. Unless you are going FI or bigger cubes not much left to do but maintain the car so it makes factory HP which is pretty well done by the bmw engineers.

Cold air intake lol.
But seriously if you're looking for a more noticable sound and maybe a little more responsiveness when first stepping on it, a CAI intake may satisfy you. It won't really make you any faster though...
