What I don't get in that vid is that he said "you tried to rear end me and my wife" and then "look what you did to my car" and "I hope you have insurance". I guess there was a fender bender perhaps? but then that's not "trying" to rear end; it's in fact, a rear end.

they guy was storming around like a gorilla. what a neanderthal.

the vid is good for a criminal threat and vandalism arrest. dishonorable discharge and he can never own a firearm if convicted.

"After forcing the truck to hit his car because of slamming on his brakes numerous times, the truck hits his car. Minor scratches to his car, the truck needs a new bumper and grill. Road rage much? He purposely forced an accident and gets out of his car and starts doing this. A real motivated Sgt disrespecting a fellow Marine who is in a wheelchair and the driver who is a civilian. At the End of the video you see him place his hands on the trunk, well that is because the MP's pulled up and arrested him."

lol watched it again. he totally became a wild animal when he started screaming. like WTF!!! hahaha I'm sure someone pissed in his cereal that morning. lol I guess that woman's voice at the end, where she says, "don't get out of the car" is from the MP. awesome that a woman will get in there and enforce sh*t. lol.

the thing that scares me abt these events is how these people must treat their own family when their guard is down, vs. treating strangers when people are normally more reserved. I guess they don't think of strangers the same way I do...

What I find ironic is the "get out so I can beat your ass" juxtaposed with the "I hope you have insurance". Insurance is a legal, paperwork, rules and policies-driven system. Roadside ass beating is the opposite. Its humorous to me that this meathead would be considering both at the same time.

could you legally brandish a weapon in that situation?

No "brandish" law here, just don't point a gun at someone without cause to shoot.

no. i would start the truck and try to drive away from the threat, but if the truck was immobilized, that would be a problem. you could articulate brandishing and/or using a firearm it if it appeared the enraged man was gaining access to the inside of the vehicle. he already voiced his intent.
if he had a weapon (tire iron, knife, piece of wood, brick, etc.), while acting like that, and i couldn't move my vehicle, and he was making an attempt to access me or my passenger- i'd blast him.
