Changed from 16" to 17" wheels. Tire diameter remained the same. A reason for exclusion? Suppose I can always "barrow" someones 16's.
Probably a moot point, no cracks last time I looked. Last edited by TerryH; 06-24-2009 at 02:05 PM. |

most of us have modified suspensions, maybe bring the car to indy shop and have it fixed, send receipts to bmw for re-imbursement. how about that?

im not good with any of this "legal mumbo jumbo" but i just got my letter in the mail today regarding this and it kind of baffles me. the only "mods" ive done to my car are cosmetic (lights, engine covers, painted calipers, and window tint) well that and a K&N cone intake. So im assuming none of these would void me from being able to receive this? but im wondering what do i do from here? am i supposed to call the nearest BMW dealership to me and make an appointment? and if so do i have to pay for all the work and what not and then get reimbursed? or is everything complimentary off the bat? i.e. its all free?
could someone PM me and lmk what they did or what i should do from here Please and thanks

Just got the paper work for this lawsuit, what if I don't have the damage (I hardly drive my car), but if it happens in the future, am I still covered, what should I do?

Why are people rushing out and making appointments? Unless someone can point me to something more current, as easyIsle mentioned, the settlement has not even been approved yet. And then there is 1 year from settlement date to have inspection and repairs.
I keep reading about people making appointments and think I must be missing something. Please correct if if I wrong - the settlement has not been reached yet, right? Quote:

Just received the letter two days ago. My attorney is reviewing it just in case.
BTW, will a damaged subframe cause one side of the car to be lower than the other? |

sure the inspection is free....but when they determine that the car actually needs repair (costs to BMW) it will be DQ''d.
My guess though is, that LSD's, big brakes, etc....will get a DQ but that an aftermarket wheel set or other calipers etc....will certainly be overlooked as irrelevant as they will be trying to avoid other legal arguements which will cost much more than just completing the work. http://en.wikipedia.org/wiki/Magnuson-Moss_Warranty_Act |

OK - Here's my status. Called Brecht BMW. Stated I had received a letter, and before I could tell them more, they said "was it about the issue with the subframe?" I said yes, and they said I needed to come in as soon as possible for a free inspection. They even set me up with a loaner car. So next Friday, 7/3, I will go in and see what's up. I will keep you posted on results.

ths problem was noticed a long time ago. There are kits out there that address the issue. Turnermotorsports and HPF have versions of the plates and kit that if you really want it fixed will address the issue.

^^ yeah but why should we spend our money on parts and labor when BMW should be the ones covering the bill since it really seems like they knowingly designed a insufficient subframe for our cars.

Why are people running out and getting this fixed before the court settles any type of agreement? What if the court doesn't find BMW liable? If you fixed your car with the hopes of getting reimbursed and then the settlement doesn't happen then you would be screwed!

Hell yeah. Putting on an "E46Fanatics" decal constitutes modified for racing in this screwed up settlement I'm sure.

![]() Perhaps even participating in this Forum, with a photo of your car in the archives could be construed as a reason to DQ. ![]() I would rush out and return my car to stock, and remove any internet references to my car when modded, and never, ever show my license tag in any image. |

I bought my car with 18" BMW wheels. The window sticker says it came with 17s. So, I'm probably out. I don't have a BMW dealer for 90 miles anyhow. I'd like to get it checked. We do have an independent shop that works on BMWs, Volvos, Audis, etc. Would they be able to do this and be covered by the lawsuit should it go through?

What happens if you get it checked and they say its fine then a couple months later it blows? (But its still before the year ends.)

Update:
Just got a call from the dealer & said, there is a small crack on the rear subframe. Since the car was modified (h&r spring, 19" wheel) they can not do anything in regards to repairing the crack, but they took pictures & sent it to BMWNA for review if they will approve the repairs. So I'm on my way to get my car & hope the crack wont get worst... |
