Can anyone confirm whether it's JUST US cars effected by this subframe problem, or is it ALL E46 cars worldwide? I'm not fussed about the legal action, but I do want BMW UK to inspect my car for such a failure if it is likely.

Of cars of a similar year, im sure they are identical in respect to their frames. I do not know for sure, but it would definitely increase their costs to build different versions for each country. My bet = the same

F.Y.I. ..I received the letter awhile back & called the attorney's office that is on it about this.

My 323Ci came with 16" wheels, but I purchased aftermarket 17" wheels ....
A SIZE THAT WAS AVAILABLE FROM BMW THAT WOULDN'T HAVE REQUIRED ANY OTHER SPECIAL ORDERING.
Therefore, said the attorney, as long as this was not done for the purpose of racing (ie> suspension
mods, etc.), YOU WOULD BE COVERED.

I personally don't car if the car is a RACE car. The happens to them stock period.

This whole aftermarket suspension and wheels BS is just a loop hole for them to say "No, sorry we can't fit it".

Prove to me aftermarket components caused this, then I'll believe it. This is an OEM defect.

Since the car was modified (h&r spring, 19" wheel) they can not do anything in regards to repairing the crack, but they took pictures & sent it to BMWNA for review if they will approve the repairs. So I'm on my way to get my car & hope the crack wont get worst...
That is such BS.

I had this happen on my e36 and both of my e46s, however I no longer have the cars. I gotta find the repair bills but I had it fixed fairly cheap ~$1000 bucks a piece i think. Maybe less.
Think if I just present BMW with the bills they'll cut me a check? Wow I just chaulked it up as a loss.
I love free money if this works out...

For those of you in the KC metro area where there is only one dealership and have free will to offer poor customer service. Baron BMW is not offering free inspections. They're taking a "wait and see" approach until after the court date. I went ahead and made an appt. for the end of august as likely there will be a flood of customer requests. If I know Baron they will only make available a few time slots per day as this is hardly a money making venture for them.
I think my next purchase will be a switch back to Audi (hmm... 2010 S4), their local dealer is very easy to work with (and wife went to HS with the owners son)

Got my letter today. I'm about to get the subframe reinforcement done this summer as preventive maintenance. Would be nice if I could get some cash for this...it will be like free money!

Which Massachusetts dealership? Herb Chambers in Allston? Foreign Motors West? etc.

That seems like a pretty liberal policy for any of the dealers in the area to be offering at this point since the settlement has not been accepted or finalized.

This actually pisses me off..... again, I know it's not finalized yet.... but just knowing I'm DQ'd right of the bat b/c I have an aftermarket suspsension pisses me off. I didn't do it for racing, but did it b/c the old suspension had gone bad, real bad... so when I bought my car, i bought it for less knowing I had to replace the suspension... I have touring bilstein and eibach springs, and replaced the control arms too.... so I'm really out or do I have a chance, seeing that someoen earlier posted saying their dealership was sending a note for approval?

Any corelation between the sub frame defect and the high incidence of broken rear springs?

I've had a big clunking noise when I hit bumps that sounds like it's coming from the rear deck right under the back window, maybe it's subframe noise???
get polyurethane from forum sponser they last 3x longer.

Does it clank over speed bumps ?
Driving slow in neighboorhood ?

Yet another F.Y.I. on this...
..I called Open Road BMW here in Central Jersey today.
They said if you have the letter the inspection is FREE....along with any other diagnostics that they happen to do when they give the car an inspection. Open Road are usually hard-asses, so I would have to guess that a number of dealers across the country are already checking this out for free.

Of course, if there are any cracks they don't pay for it, they just refer you to someone that can weld it.

Those of you receiving letters, are you referring to the letters for the lawsuit or a letter from BMW?

Regards,
Loay

I called Brecht BMW in Escondido, CA and said I wanted to come in regarding checking for subframe issues, and before I could say I got a letter, they said "is this in regard to the letter you received?" I said yes, and they said bring it in for a free inspection and they even gave me a loaner for my time. I'll let you know what happens after Friday 7/3.
