Pulled over again by the same cop - Ticket for obstructing windshield, STEVE!
So a few months back I was getting some gas, notice a bike cop (local PD) had a woman pulled over in the gas station. I drive a loud car, so I'm pretty sure this is going to be a hassle when I leave. Of course, officer pulls me over as soon as I leave the station. I am respectful as I usually am with most police officers until they cross a line. This guy, exceeded that. He ticketed me for everything under the sun and told me the reason he pulled me over was my sunglasses were too big. Well.... alright, fine. Told him I was dragging his ass to court and would have everything thrown out.
Fast forward a few months, I drag his ass to court with evidence and all sorts of stuff to get it thrown out. Turns out the moron forgot his paperwork, had 6 cases thrown out and was laid into by the judge. This morning. The SAME FUC!IN COP pulls me over. I immediately notice its the same guy so I'm a little hesitant, but still respectful, maybe he changed his ways. Nope. The as*shole decides today hes going to ticket me for everything again (front license plate, clear corners, too low, modified exhaust (all the same sh!t)) and this time the icing on the cake is I have a sticker in my windshield obstructing my view! ![]() Guess its back to court. Think this guy might be targeting my car at this point, any recourse I can take against this officer?

just because you got off on the grounds that the officer wasn't prepared doesn't mean your car still violates your state's vehicle code. he can ticket you every day for the same for the same violations.

The problem isn't that. Last time half the charges were dismissed because I had them inspected at the trooper station and they were all legal. The officer in question doesn't know/understand the citations he is ticketing me for. The other half were silly things like not having registration, license with wrong address, which you really should just be warned for, but of course he gives me a ticket. Whatever, I'm fine with that, fixed it and had it dismissed with proof.

Now that's an idea! Here in hillbilly land most cops don't much care or I'd be screwed on the exaust aspect.

You can file a restraining order if this happens a few more times. A friend in Scripps Ranch(San Diego) did this against a cop, as the cop kept pulling him over and ended up issuing him 15 tickets on 15 different occasions, but this only happened twice for you so I'm sure that would be a final recourse if it happened many more times.

talk with your local police department. it won't help you if you get ticketed each time and have to go through the same thing each time. they don't want to waste time either going to court and having things dismissed that are allowed. as much as many people hate the police, most departments actually want to help the citizens in their city, so talking constructively with them can actually be very beneficial.

If what you say is true, the officer has now given you solid grounds for filing an official oppression/unlawful detainment, criminal lawsuit against him and his department, professionally and also against him personally, civilly.
If he now knows (proven instruction by court) that your actions/vehicle are within the vehicle code, he is unlawfully acting towards you under the color of law.

Good luck OP, its too bad you can't clear all the fix it stuff over at a CHP office over a lunch break and have to waste your time in court.

It's annoying. No doubt about it.
As long as you're respectful, courteous and not breaking any laws... let the cop do his thing, he'll get tired of it soon enough. Who's to say it's not on a quota for the month? Have a "Thank you and have a nice day" card, just in case he stops you a third time. Here's a mental attitude > Look at it this way, least you have a police officer watching your back. (Just think if you really needed a cop... and one's where to be found.) |

There is no evidence of a complaining party, and there are constitutional loopholes based on this idea.
Check out Marc Stevens on the internets, and you can learn for free, how to politely, and respectfully get out of these type of tickets in the courtroom. My girfriends father is a friend of Marc and, he has helped people beat tickets using Marc's methods.

No front plate, loud exhaust, No registration, and a banner. The only thing you're missing is front tint The only reason I say all this is because I'm in the same spot you are. My car currently has a loud exhaust I have tint on all 6 windows of the car. 15% all around and 55% on the front. I have smoked corners as well. My car defiantly turns heads when I drive by local leo's. When they pull me over I'm respectful also, as you stated you are as well. However I can't complain when the leo is just busting my balls lol. I hate it, but I can't get mad because at the end of the day I'm violating local laws. I think if you had a current registration and fixed the issue with your license the leo wouldn't have busted your stones about the banner and front plate. Clear corners is a new one though. In my state they are allowed to be clear or amber colored and blink white or amber. Most corners are DOT certified as well. Good luck to you. I would just recommend that you straighten some of the "Silly" things out and I think you will have a more peaceful driving experience |
