SES light p2237 and p2240??? Software or O2 sensor?

I've just purchased my 325ci with 89k miles, and about a week ago I recieved a SES light code p2237. It went off after a few days and yesterday the light came back on with a new code p2240 and p2237 was still pending. I've done some research and have read a lot of people talking about a dme software upgrade to the ecu. Most of the threads I looked over said this fixed the problem and that people have wasted money trying to replace the O2 sensor. The code comes up as bank 1 and bank 2 O2 sensors before the cat. Anyone have a solid answer on this before I spend about $300 on two O2 sensors? If it is the software update, would I have to get an update for the transmission too?

Thanks for the space!
