You should layout the chronological timeline in summary and back it up with as much detail as possible so that he can fully appreciate your frustration/situation. The community can't solve the problem for you, that is up to DPE, but hopefully this helps.

I think it's pretty obvious they don't want to give you the money back. Plus you can't possible know who is or is not telling the truth especially since they won't talk to you. I would get your bank involved; don't know if Visa/MasterCard gives you any rights but I would definitely check it out.

Were you ever actually charged for the deposit? In the case of debit cards they are (usually) underwritten by visa/mastercard. Visa or Mastercard provide the insurance against fraud on the card on your behalf through the bank (they make it up on federally regulated service fees). The bank purchases the transaction service from the card company. You contact the bank, the bank turns it over to their internal fraud division, they research whether or not the fraud case is ligitmate, and they in turn work with the card company to insure the claim. The problem you may have with this is that there is a time limit to submit your claim, usually 30 days.
If the bank won't work with you because too much time has lapsed you might be stuck picking up the wheels and appealing to DPE to make things right through the vendor.
