Question ethical question: would you lie under oath if it was the only way to get justice?

like if you get evidence that proves someone is guilty of something bad, but couldn't submit it in court because it was obtained illegally (illegal confession, videotape, phone tapping, hacking, etc), and knew without that evidence the guy would get off scott free..

then would you lie under oath to get a guilty conviction if you knew the lie would never be discovered?

not looking for a legal discussion here... more of an ethical question.

i would not lie. the truth is the truth and its the right thing to do; period.

straying from the guidelines of legalities to get a conviction and then covering it up with a lie is not obtaining justice. so you see, your title makes no sense.

I wouldn't lie, of course, but I'd use that evidence somehow.

If you've obtained info illegally, the other side probably doesn't know you have it, but you can leverage the knowledge you have...the other side doesn't know how you have what you have, but you can signal, somehow, that you have it.

That said, I can imagine some cases where I'd be greatly conflicted about telling the truth...if murder, pedophilia, beastiality were involved, for instance!

I'm having a hard time thinking of a situation where this would work and not get tossed out on appeal. But I don't practice in this area of law so maybe someone can enlighten me.

I think law enforcement does this a lot to get warrants. They have some illegal evidence (the veracity of which is questionable) and then will testify before a magistrate in order to get a warrant to find their primary evidence.
