Neighbor Parked Illegally and Now I Have to Pay

Hey guys,

So just now I was going to leave the house and meet a friend. I have this neighbor who parks his 2002 Mercedes C class behind my garage door 90% of the time.

Most of the time I can (barely) maneuver around it. Over the past year for reference I have probably asked him politely to move his car 12-15 times. This is like a monthly occurrence and has even made me late to work more than once.

Today, I was pulling out and his car was not directly behind my garage like normal, nor was it far enough away that I could make the cut to turn out without touching his car. I looked back, didn't see anything and proceeded to reverse. Suddenly I felt something and looked back to see his POS car sitting there. I get out and it turns out I didn't even "hit" his car. I actually had dragged my rear bumper along his front license plate holder.

In other words, there was ZERO damage to his car, and my rear bumper now needs to be pulled off and resprayed. I walked to his door to tell him what had happened and as he answered the door he already knew why I was there. "Oh no, I'm in your way again?" "No, it's worse this time".....

Once he saw that his car had suffered no damage it became a laughing matter to him. He smiled at me and asked "what would you like me to do?" I said I thought it was fair that he at least help for my bumper repair ($$$). He told me I was out of line asking him to do so and we got in an argument from there.

I was frustrated and he was acting like a stoned hippy. He kept saying "I don't like the way you're approaching me, mannnnn".

At this point I got pissed and did what I hate to have to do and called the cops. I didn't want my neighbor to find out my insurance company called his and then try to say that I damaged his car.

When the cop showed up I explained to him that my neighbor's car was illegally parked. He told me that since we are inside the subdivision and it's private property, that it doesn't matter. He told me that my neighbor could park behind my garage every day out of the year and he couldn't do anything about it. All he could do was put in his report that there was no damage to the other car, and that the neighbor attested to the fact that there was zero damage as well. I made sure that he did both so I could cover my a$$. Now I'm going to have to contact the homeowners association and my guess is that they'll tell me to take it up with the police. What a drag.

Anyways, would you guys have handled it any differently?

It's a matter to settle with your HOA, not the police. Take it up with them for not enforcing the parking rules. That, or don't run into parked cars in the future.

no, not at all. I just thought that since he parks there ALL THE TIME (to keep his car in the shade), and knowing that I have asked him to move his car so many times that he would've at least accepted 50% of the responsibility.

I took pics of the damage and placement of the cars but the garage can't easily be seen from my photos. Sorry

Step by step instructions:
1. Kill him.
2. Put his body in the trunk of his C.
3. Drive his car to the junk yard.
4. Crush his car.
5. Call a friend to come pick you up & drive you home.
6. Forget it ever happened.

Seriously though, you handled it perfectly. Call a tow truck next time.

Any verbal agreements between you and this neighbor? Anything like "Sure, you can park there, as long as you move when I need to get out" ?

Not that it makes any difference legally, but it would help in assessing the situation.

Never, in fact he could always tell I was frustrated to see his car blocking me in AGAIN when I would ask him to move it.

He's wrong to park there, but you're wrong to think he should pay for damage to your car when you tried to squeeze by.

No offense, but I'd laugh in your face too. Of course, I wouldn't park there in the first place, but you're not getting a penny out of him.
