I don't know the outcome in his situation , but at best I would have them both fired and a handsome lawsuit deposit in my bank account. At worst, it would be made extremely public and painful for those officers about their wrongdoings so others became aware that their action were wrong

After he was treated like **** and searched etc. he wasn't detained, so what makes the outcome different? What did he gain by keeping his window up? Sounds like it made things worse to me. Either way he isn't in jail, or are you saying that if he did roll down his window he would be in cuffs? Don't want to go to jail, don't break the law. Pretty simple way to live if you ask me.

In no way am I saying he should give up all his rights, but to me there is a happy medium. In the end its all about choice, you choose to act how you want in a certain situation.

I dunno jonjon, rolling your window down to speak with an officer is hardly consenting to a strip search. I know your coming from a "you give an inch and they will take a mile" angle but I just don't see how having the window rolled down more than 2 inches is somehow leaving you open to getting butt****ed in prison.

that's the thing, he didn't have to give up any of his rights! all he had to do was roll his window down before he ever got to the officers. problem solved.

Up to you guys. No requirement we have to agree here

The ONLY reason an officer would ever be upset with a window not fully down is:

1. Impedes them from discovering more evidence against you

2. How dare you not obey my order!?

A police encounter is all about "power and control". There is no reason why you need to give any of that leverage up to an officer UNLESS after being informed that you're under arrest. Then you comply (but still can exercise rights not to self incriminate 5th)

So far all of my police encounters have been pleasant.
I know most of the cops around here. They are generally well trained, informed and respectful.

I also don't break the law so there is very little if any need for us to interact
I avoid and make UTurns when I see DUI checkpoints
It's a waste of my time

Seriously though, the best advice I got about police interaction was from a coworker who was a retired Sheriff.

I don't blame the police for using tactics to fish, the laws make it very hard to get convictions. What I do have a problem with is when officers abuse their power or getting emotional when someone who knows their rights asserts them.

The proper way to respond is to continue to look for RS or PC in a LEGAL way and let them be on their way if you dont find any. If you take it personal, you have issues.

Another DUI checkpoint video (4 July 2013).

Everyone is getting really bent out of shape over this.

Really, I'm sure the kid doesn't do this on a regular basis. He probably just made this single video as an example of how some of our right are going slowly down the drain.
