Need some advice.... Fined for fender -wheel clearance

On my way home, cops were camping on one of the roads and pulling over all the cars that were coming to them in the left lane and sadly I got pulled over

I was breath tested and they even made me pop open my bonnet etc pretty standard stuff. They couldn't find anything until one of them said to me that my fender has less than 100mm clearance and that it was illegal. I copped a $110 fine but they said it wasnt a defect. They proceeded to take a photo etc.

Anyway, I went home and looked up the Queensland transport department website regarding clearance and I only found laws regarding Ground clearance. I could not find anything about fender clearance.

So here's my questions:
1) has anyone here ever been fined for having low fender clearance? Is it even a part of the law?

I seriously think the cop just didn't know that it was ground clearance of 100mm and not fender

2) should I appeal to this fine?

Any advice/ suggestions would be appreciated.

I can't read the "identifying particulars of the offence" and "information about the offence". Can you take a better scan or type it out?

My car wouldn't have anywhere near 100mm clearance between tyre and fender and it's on factory wheels and suspension.

I'm in America but it looks like <100 M . I would go to court and challenge the fine. If the cop couldn't get it right on the form, why should you pay the fine. What else did he get wrong?

I don't think that new, your car came with 100mm clearance. If the car was allowed on the road with that clearance, why should you be held liable?

I'd challenge it. Sounds like BS. Never heard of 100mm fender clearance?

lol i think he means ground clearance..did he even test it to prove it is less than 100mm..and ti317 is right, it does say 100m on there..

This kinda makes no sense to me.
How is it a fine and not also a defect?

A fine isn't a order to repair something on your car, so technically what they're saying here is,
pay the fine and maybe in another day or week or month another spiteful pig may book you again for some b/s reason.

Did you measure the clearance yourself since getting the fine?

If your car has stock suspension, clears 100mm, id take it to court and appeal it, get a letter of whoever services it for you to say it has stock suspension and is "as is" as sold from the factory and take some photos along.
Shitty thing is, its gonna cost you roughly the same to go to court and win or pay the fine.

If your car has modified suspension and you lowered it, pay the fine and hope you dont get done for it again, if you are pulled up in the future, try and push for a defect notice instead and cry you were unaware it was to low.

Thanks for all the replies guys, I have an aftermarket suspension o, OEM m3 wheels on and my car does have ground clearance of more than 100mm. I am 100% sure they referred to my fender because they took a photo of the wheel.

Also, I can't even understand what the officer wrote on the page as well, he just scribbled.... He said to me it wasnt a defect but I could get fined again if I drove the car out without fixing it.

This is the left rear wheel that they took a photo of.

My front wheel however has like 0 fender clearance but they didn't say anything about it, instead took a photo of the rear wheel.

This is what my front wheel looks like .

If he fined you for one side, Why did he not use the other side as an example also? One wheel/guard will not sit lower than the rest of the car.

I'm calling bullshit on the fine, I personally would contest it. There are enough discrepencies to base your contestment on.
